FUJIFILM 2022 GFX CHALLENGE GRANT AWARD PROGRAM PRIVACY POLICY for Europe

This Privacy Policy describes commitment of FUJIFILM Corporation and its subsidiaries (“FUJIFILM” or “we”) to protection of data privacy and how we treat the personal data that we collect from applicants of the FUJIFILM 2022 GFX CHALLENGE GRANT AWARD PROGRAM (“Program”). By applying for the Program, you acknowledge that you have read this Privacy Policy, agree to the below terms, and consent to our processing of your personal data in accordance with this Privacy Policy.

1. Scope
1.1 Scope of This Privacy Policy
This Privacy Policy applies to the collection, processing, disclosure and use of your personal data in relation to applying for the Program and implementation of the Program. This Privacy Policy applies to both FUJIFILM and its subsidiaries to the extent applicable related to the collection, processing and use of your personal data under the conditions of this Privacy Policy.

2. Collection and Management of Personal Data
2.1 Collection of Personal Data
The data controllers with regard to your personal data are:
(a) Name
(b) Country or region of residence
(c) E-mail address
(d) Manufacturer of digital still camera which you use (if provided by you on a voluntary basis)
(e) Data related to your application

If you become a winner of this Program and are invited by FUJIFILM to shoot the behind-the-scene movies while you conduct your shooting project using Fujifilm GFX Series which you entry, we will collect additional personal data from you, such as your portraits, images and voice. We will provide a separate privacy statement to you and obtain your separate consent for such additional purposes.

2.2 Purpose of Use of Personal Data
We process, store and use your personal data for the following purposes:
(a) Informing matters related to the Program
(b) Contacting you regarding your entry (including to arrange interview at the 2nd preliminary round)
(c) Announcement of the winners on FUJIFILM’s website
(d) Implementation of the Program
(e) Notification of results of 1st preliminary round and the final selection of this Program
(f) Creating statistical data for market research and marketing purposes without identifying individuals (limited to the information described in Article 2.1 (b) and (d))
(g) Sending information about FUJIFILM’s products and services

The use of personal data provided by you shall be limited to the purposes above. However, we reserve the right to conduct additional processing to the extent permitted or required by relevant laws and regulations, or if we are authorized or required to use your personal data in support of any legal or criminal investigation.

If you subscribe to our newsletter(s), we will use the Personal Information necessary or separately provided by you to send you our email newsletter(s) as agreed. Newsletter emails may contain web beacons, tracking pixels or links that allow us to analyze your use of the newsletter, including information on whether you received and opened our newsletter. You may withdraw your consent and unsubscribe from the newsletter at any time either by sending a message to us or via a dedicated unsubscribe link in the newsletter.

We will retain your personal data for a reasonable period considering the purposes above, or for a storage period required by relevant laws. When all of the above purposes have been achieved, or when personal data is no longer needed, we either irreversibly anonymize or securely destroy such personal data.

2.3 Data Sharing and Disclosure
We share your personal data when:
(a) your consent is given in advance;
(b) sharing your personal data with subsidiaries of FUJIFILM companies or third parties processing on our behalf which is necessary to implement the Program;
(c) we determine from your inquiry in relation to the Program that it is appropriate for affiliated FUJIFILM companies that is responsible for region to respond to your inquiry;
(d) our business is assigned or transferred either by operation in law or otherwise including mergers, consolidations and dissolution or transfer of operations;
(e) disclosure of your personal data is required by applicable laws and regulations or if we are authorized or required to such disclosure in support of any criminal or other legal investigation or proceeding conducted by relevant authorities; or
(f) there is an immediate need for disclosure to protect human life or human rights.

We will not disclose or supply, share or otherwise distribute your personal data to third parties except as described in this Privacy Policy.

2.4 International Data Transfer
We may transfer the personal data we collect to, and store such information in, other countries/regions which may have different privacy or data protection laws than the country/region in which the information was collected. In such case, we will take appropriate measures to protect your personal data.

2.5 Data Security
FUJIFILM takes adequate and reasonable technical and organizational security measures in order to protect your personal data from being misused and to prevent the loss of your information. Your personal data will be saved in a secure operating environment that is not accessible to the public. All personal data provided by you in the course of registration or use of personalized services will be transferred in encrypted form in order to prevent misuse of it by any third party.

2.6 Your Rights relating to Your Personal Data and Contact Information
You have (i) the right to access, correct or delete your personal data, (ii) the right to restrict the processing of your personal data, and (iii) the right to object to processing as well as to data portability. You may withdraw your consent about collection, use and processing of your personal data set forth in this Privacy Policy at any time with effect for the future.

Depending on your location, you may have the right to lodge a complaint with a competent supervisory authority in accordance with the applicable laws if you consider that the processing of personal data relating to you infringes the applicable laws. 3. Children’s Personal Data
Children or minors as defined under local laws can’t apply for the Program. If the applicant is found to be a child or a minor, we won’t collect your personal data. According to the Terms and Conditions of the Program, you must reach 18 years of age and the age of majority in your jurisdiction of primary residence in order to apply for the Program.

4. Changes to the Privacy Policy
FUJIFILM reserves the right to change, amend, or update this Privacy Policy without prior announcement and without stating its reasons. When we change, amend, or update our Privacy Policy, we will notice to you of the changed Privacy Policy to the registered e-mail address. Unless you withdraw your application after such notification, it will be deemed that you have agreed to be bound by such changed Privacy Policy.
